• Criminal Rule 39 (appointment of counsel) Changes Effective May 15, 2005 (5/10/05)

    E-mail from Susanne DiPietro explaining the problem created by the Legislature in 2004 when it amended this statute (and two other statutes involving minors, 28.35.285 and .290) to add mandatory community work service (CWS) to the penalty for the offense. The statutes clearly state that all three offenses are infractions, but the mandatory CWS probably means that the defendants have a right to court-appointed counsel and a jury trial. In order to be sure the defendants are notified of these rights and given these rights, Susanne suggests that it is better for the courts to process these charges as criminal offenses rather than as minor offenses, even though the defendants can only be convicted of an infraction. That is, she proposes that these offenses be treated the same way we handle Minor Consuming.
